§ 7 Right of withdrawal from the contract
- The Protected Buyer has the right to withdraw from a contract concluded with the Seller through the Shop within 14 days without giving any reason, subject to § 8 of the Terms.
- The withdrawal period expires 14 days after the day:
- on which the Protected Buyer acquires, or a third party other than the carrier and indicated by the Protected Buyer acquires, physical possession of the goods;
- on which the Protected Buyer acquires, or a third party other than the carrier and indicated by the Protected Buyer acquires, physical possession of the last good, lot or piece – in the case of a contract for the transfer of ownership of multiple goods delivered separately, in lots or in pieces.
- To exercise the right of withdrawal, the Protected Buyer must inform the Seller of their decision to withdraw from the contract by an unequivocal statement (e.g. a letter sent by post or email). For this purpose, the Protected Buyer may use the Seller’s details given in § 2 of the Terms or the withdrawal function referred to in paragraph 4.
- The Protected Buyer may exercise the right to withdraw from a contract concluded online by using the withdrawal function available at https://lorgar.pl/news/n/55/Complaints-Returns. If this function is used, the Seller will, without undue delay, send the Protected Buyer an acknowledgement of receipt of the withdrawal on a durable medium (e.g. by email), including its content and the date and time it was submitted.
- The Protected Buyer may use the model withdrawal form set out at the end of the Terms, but this is not obligatory.
- To meet the withdrawal deadline, it is sufficient for the Protected Buyer to send their communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.
EFFECTS OF WITHDRAWAL
- If the Protected Buyer withdraws from the contract, the Seller will reimburse all payments received from them, including the costs of delivery (with the exception of any supplementary costs resulting from the Protected Buyer’s choice of a type of delivery other than the least expensive type of standard delivery offered by the Seller), without undue delay and in any event not later than 14 days from the day on which the Seller is informed of the Protected Buyer’s decision to exercise the right of withdrawal.
- The Seller will carry out the reimbursement using the same means of payment as the Protected Buyer used for the initial transaction, unless the Protected Buyer has expressly agreed otherwise; in any event, the Protected Buyer will not incur any fees as a result of the reimbursement.
- Unless the Seller has offered to collect the goods from the Protected Buyer itself, it may withhold the reimbursement until it has received the goods back or until it has been supplied with evidence that the goods have been sent back, whichever is the earlier.
- The Seller asks that the goods be returned to: ul. Słowikowskiego 81C, Building H4, 05-090 Raszyn, Poland, without undue delay and in any event not later than 14 days from the day on which the Protected Buyer informed the Seller of their withdrawal from the sales contract. The deadline is met if the Protected Buyer sends back the goods before the 14-day period has expired.
- The Protected Buyer bears the direct cost of returning the goods.
- The Protected Buyer is only liable for any diminished value of the goods resulting from handling them in a way other than what is necessary to establish the nature, characteristics and functioning of the goods.
- If, by their nature, the goods cannot normally be returned by post, the Protected Buyer will also have to bear the direct cost of returning them. The Seller will inform the Protected Buyer of the estimated amount of these costs in the product description in the Shop or when the order is placed.
- If a payment made by the Protected Buyer by payment card needs to be refunded, the Seller will make the refund to the bank account linked to that payment card.
§ 8 Exceptions to the right of withdrawal
- The right to withdraw from a distance contract referred to in § 7 of the Terms does not apply to a contract:
- for the supply of non-prefabricated goods made to the Protected Buyer’s specifications or intended to meet their individual needs;
- for the supply of goods which are liable to deteriorate rapidly or have a short shelf life;
- for the supply of goods delivered in sealed packaging which, once opened, cannot be returned for health protection or hygiene reasons, if the packaging was opened after delivery;
- for the supply of goods which, after delivery, are by their nature inseparably mixed with other items;
- for the supply of sound or video recordings or computer software delivered in sealed packaging, if the packaging was opened after delivery;
- for the supply of newspapers, periodicals or magazines, with the exception of subscription contracts;
- where the price or remuneration depends on fluctuations in the financial market which the Seller cannot control and which may occur within the withdrawal period.
§ 9 Complaints
I. General provisions
- The Seller is liable to the Protected Buyer for the conformity of the performance with the contract, as provided for by generally applicable law, in particular the Consumer Rights Act.
- The Seller asks that complaints (including those concerning the operation of the Shop) be submitted to the postal or email address given in § 2 of the Terms.
- If a guarantee has been provided for a product, information about the guarantee and its terms is available in the Shop.
- The Seller will respond to a complaint within 14 days of the day on which it is received.
II. Protected Buyers
- Goods
- If the goods are not in conformity with the contract, the Protected Buyer may exercise the rights set out in Chapter 5a of the Consumer Rights Act.
- The Seller is liable for any lack of conformity of the goods with the contract which exists at the time of delivery and becomes apparent within two years of that time, unless the period of suitability for use of the goods specified by the Seller, its legal predecessors or persons acting on their behalf is longer.
- Under the Consumer Rights Act, if the goods are not in conformity with the contract, the Protected Buyer may demand:
- replacement of the goods,
- repair of the goods.
- In addition, the Protected Buyer may declare:
- a price reduction,
- withdrawal from the contract
- the Seller has refused to bring the goods into conformity with the contract in accordance with Art. 43d(2) of the Consumer Rights Act;
- the Seller has not brought the goods into conformity with the contract in accordance with Art. 43d(4)–(6) of the Consumer Rights Act;
- the lack of conformity of the goods with the contract persists even though the Seller has tried to bring the goods into conformity;
- the lack of conformity of the goods with the contract is so serious that it justifies a price reduction or withdrawal from the contract without first using the remedies set out in Art. 43d of the Consumer Rights Act;
- the Seller has stated, or it is clear from the circumstances, that it will not bring the goods into conformity with the contract within a reasonable time or without significant inconvenience to the Protected Buyer.
- Where goods are to be repaired or replaced, the Protected Buyer should make them available to the Seller. The Seller collects the goods from the Protected Buyer at its own expense.
- The Protected Buyer may not withdraw from the contract if the lack of conformity of the goods with the contract is minor.
- In the event of withdrawal from the contract referred to in this section (concerning goods), the Protected Buyer returns the goods to the Seller without undue delay, at the Seller’s expense, to: ul. Słowikowskiego 81C, Building H4, 05-090 Raszyn, Poland. The Seller refunds the price to the Protected Buyer without undue delay, and no later than 14 days from the day on which it receives the goods or evidence that they have been sent back.
- The Seller refunds to the Protected Buyer any amounts due as a result of the exercise of the right to a price reduction without undue delay, and no later than 14 days from the day on which it receives the Protected Buyer’s declaration of the price reduction.
- Out-of-court complaint handling and redress
- The Seller informs the Consumer that out-of-court methods of handling complaints and pursuing claims are available. The rules for accessing these procedures are available at the offices or on the websites of the bodies authorised to resolve disputes out of court.
The Consumer may, among other options, seek help from the relevant European Consumer Centre within the European Consumer Centres Network. The Centres provide information on consumer rights and help resolve disputes concerning cross-border purchases. Help from the European Consumer Centres is generally free of charge. A list of the Consumer Centres competent for each country is available at: https://konsument.gov.pl/eck-w-europie/ (in Polish) and on the European Commission website: European Consumer Centres Network (ECC-Net) (in English).
In addition, the following forms of support are available in the Republic of Poland:
- mediation conducted by the locally competent Voivodeship Inspectorate of Trade Inspection (Wojewódzki Inspektorat Inspekcji Handlowej), to which a request for mediation should be submitted. The proceedings are generally free of charge. A list of the inspectorates is available here: https://uokik.gov.pl/kontakt-inspekcja-handlowa
- assistance from the locally competent permanent consumer arbitration court operating at the Voivodeship Inspectorate of Trade Inspection, to which an application for the case to be heard by the arbitration court should be submitted. The proceedings are generally free of charge. A list of the inspectorates is available at: https://uokik.gov.pl/kontakt-inspekcja-handlowa
- The previous provision is for information purposes only and does not oblige the Seller to use out-of-court dispute resolution methods.
- The use of out-of-court methods of handling complaints and pursuing claims is voluntary for both the Seller and the Consumer.
- The Consumer may also obtain free assistance from a municipal or district consumer ombudsman (miejski lub powiatowy rzecznik konsumentów).
- The Seller informs the Consumer that out-of-court methods of handling complaints and pursuing claims are available. The rules for accessing these procedures are available at the offices or on the websites of the bodies authorised to resolve disputes out of court.
III. Buyers other than Protected Buyers
- If the goods are defective, a Buyer other than a Protected Buyer may make a complaint about the defective goods under the statutory warranty for defects (rękojmia) provided for in the Civil Code.
- The Seller is liable under the statutory warranty to a Buyer other than a Protected Buyer if a physical defect is discovered within two years of the day on which the goods were handed over to the Buyer.
- Under the Civil Code, a Buyer who is an entrepreneur other than a Protected Entrepreneur loses their rights under the statutory warranty if they did not examine the goods at the time and in the manner customary for goods of that kind and did not notify the Seller of the defect without delay, or – where the defect became apparent only later – if they did not notify the Seller without delay after discovering it. To meet this deadline, it is sufficient to send the notice of the defect before the deadline expires.
- Under the statutory warranty, a Buyer other than a Protected Buyer may, on the terms set out in the Civil Code:
- declare a price reduction,
- in the case of a material defect, declare withdrawal from the contract,
- demand that the goods be replaced with goods free from defects,
- demand that the defect be removed.
- If it turns out that the defective goods need to be delivered to the Seller for the complaint to be handled, a Buyer other than a Protected Buyer is obliged to deliver the goods to: ul. Słowikowskiego 81C, Building H4, 05-090 Raszyn, Poland.
§ 10 Personal data
- The controller of the personal data provided by the Buyer when using the Shop is the Seller. Detailed information on the processing of personal data by the Seller – including the other purposes and legal bases of processing and the recipients of the data – is provided in the privacy policy available in the Shop, in line with the principle of transparency laid down in the General Data Protection Regulation of the European Parliament and of the Council (EU) (the “GDPR”).
- The Seller processes the data provided by the Buyer in connection with purchases in the Shop in order to fulfil orders. The legal basis for processing personal data in this case is:
- the contract or steps taken at the Buyer’s request prior to entering into it (Art. 6(1)(b) GDPR),
- a legal obligation of the Seller, relating in particular to accounting and product safety (Art. 6(1)(c) GDPR), and
- the Seller’s legitimate interest in processing data in order to establish, pursue or defend possible claims (Art. 6(1)(f) GDPR).
- Providing data is voluntary on the part of the Buyer but necessary to conclude the contract. If the data are not provided, it will not be possible to conclude a contract in the Shop.
- The Buyer’s data provided in connection with purchases in the Shop will be processed until:
- the contract between the Buyer and the Seller ceases to be in force;
- the Seller is no longer subject to a legal obligation requiring it to process the Buyer’s data;
- the Buyer or the Seller can no longer pursue claims relating to the contract concluded through the Shop;
- the Buyer’s objection to the processing of their personal data is accepted – where the processing was based on the Seller’s legitimate interest
- The Buyer has the right to request:
- access to their personal data,
- rectification of their data,
- erasure of their data,
- restriction of processing,
- transfer of their data to another controller,
- to object at any time, on grounds relating to their particular situation, to the processing of personal data concerning them that is based on Art. 6(1)(f) GDPR (i.e. on legitimate interests pursued by the Seller).
- To exercise their rights, the Buyer should contact the Seller using the details given in § 2 of the Terms.
- If the Buyer believes that their data are being processed unlawfully, they may lodge a complaint with the competent personal data protection authority. In Poland, this is the President of the Personal Data Protection Office (Prezes Urzędu Ochrony Danych Osobowych).
§ 11 Final provisions
- The Buyer is prohibited from providing unlawful content.
- Each order placed in the Shop constitutes a separate contract and requires separate acceptance of the Terms. The contract is concluded for the time needed, and for the purpose of, fulfilling the order.
- All contracts concluded under these Terms are governed by Polish law, subject to paragraph 4.
- The choice of Polish law for contracts concluded with a Consumer under the Terms does not exclude or limit that Buyer’s rights under the mandatory provisions of law that would apply to the Consumer in the absence of a choice of law. In particular, this means that if the national law applicable to a given Consumer provides broader protection than these Terms or Polish law, that broader protection applies.
- Contracts under the Terms are concluded in Polish.
- In the event of a dispute relating to a contract concluded through the Shop with a Buyer who is not a Protected Buyer, the competent court will be the court having jurisdiction over the Seller’s registered office.
- The use of the Shop website and the features available on it is governed by the Website Terms, available in the Shop.
